Overview

Private companies are forced to grapple with evolving business models particularly in the face of unprecedented disruption and operating challenges in the current business environment.  They must find ways to best leverage their IP assets to compete, access liquidity, deflect potential competitive risks, and protect a re-imagined post-crisis future.  While IP and innovation strategy are a topic worth periodic review by the Board in any corporate context, the degree and nature of IP issues faced by a company and the importance of IP as a strategy topic can vary based on a large number of factors.  Boards are taking new approaches to determining if IP is indeed an asset that can create, enhance and/or retain value as part of the company’s strategy. This discussion will provide a strategic roadmap and framework for IP oversight and governance with the boardroom.

Lewis Lee

Lewis Lee is CEO and global head of Aon Intellectual Property Solutions, a business focused on enhancing enterprise value by executing IP-based value creation strategies and minimizing the cost of IP risk. With IP emerging as a valuable asset class, Lewis provides advanced business and data analytics to help financial and insurance industries assess and value IP assets.  Lewis is a member of the Federal Reserve Bank of San Francisco's Economic Advisory Council. He is recognized by Intellectual Asset Management (IAM) as a top 300 IP strategist worldwide, is an experienced IP attorney, entrepreneur, author, inventor and educator. Lewis is the co-founder of Lee & Hayes, a leading US patent and business law firm that enjoyed top quality ranking for multiple years on IAM’s annual rankings.  Lewis is also active in development of advanced IP tools, analytics and processes. He has co-authored two books, Intellectual Property for the Internet and Managing Intellectual Property Rights. He is a former adjunct professor for Gonzaga University’s School of Business.  Lewis has a JD from the George Washington University School of Law, a BSc in electrical engineering and a BA in business administration from Washington State University.

Rahul Pathak assists clients with intellectual property rights in the fields of chemistry and biochemistry. His practice includes patent prosecution and portfolio management, patent opinions, patent reexaminations and patent due diligence. Representative clients include start-up companies, established companies, leading life science companies, academic institutions, and investment firms in the pharmaceutical, biotechnology, renewable chemical, food and energy storage industries.  During his legal career of more than 20 years, he has advised clients on developing and managing global patent portfolios for marketed pharmaceuticals and biopharmaceuticals, conducting intellectual property due diligence for private and public investments in pharmaceutical and biotechnology companies, and developing a patent portfolio of biofuels. Rahul holds a Ph.D. in chemistry from Caltech, a bachelor’s degree from Yale University and a JD from UC Berkeley. He was named to the Daily Journal's 2015, 2014 and 2013 lists of Top 25 intellectual property portfolio managers in California – an annual list of the most highly regarded lawyers in the state who advise clients in the management of their IP portfolios or patent prosecutions.

 

Paul Roberts

Paul Roberts is a respected intellectual property expert whose scope extends from the protection to the successful strategic commercialization of IP. His experience includes leading patent legal teams at two tech-focused Fortune 500 companies, leading corporate venture capital business negotiations at two Fortune 500 companies, co-founding two startups (an IP licensing outsourcing firm and the sole licensee of a protected sustainable chemical composite, respectively).  He has served for over 15 years on the board of the Licensing Executives Society (LES) in multiple leadership capacities.  Through data-driven plans, creative risk mitigation approaches, and sound practices, Paul enhances the value of intangible assets including patents, trade secrets, copyrights, data, trademarks, brands, and commercial rights.  He received a Board Leadership Fellowship from the National Association of Corporate Directors in 2017 and was identified as within the IAM Strategy 300 (top IP strategists) by Intellectual Asset Management Magazine in 2015 and 2016.  HE received his bachelor’s degree from university of Maryland and his JD from Whittier Law School.

Nick Florio

Nick is an accomplished corporate leader, financial and risk expert, and a retired Senior Principal in Deloitte’s Risk & Financial Advisory Services (R&FA) business. His perspective and business acumen were gained from diverse experiences as a Chief Operating Officer, working engineer, military commander, and financial, turnaround, and risk expert for domestic and multi-national organizations. He has advised organizations on matters of growth, resilience, organizational readiness and risk and is skilled in Valuation, M&A, joint ventures, reorganizations, intellectual property valuation/monetization, supply chain risk, and digital transformation.  Nick also chairs the National Advisory Board of PeerForward and is the Chair of the Nominating & Board Stewardship committee of the Smithsonian Libraries and Archives.  He is a graduate of Hofstra University with a bachelor’s degree in Industrial Engineering; Columbia University with a master’s degree in Industrial Management & Economics; New York University with an advanced professional certificate in Tax and Finance; and Harvard Business School with a certificate in leading Professional Services Firms. He holds the Chartered Financial Analyst (CFA) designation, Senior Accredited Appraiser designation (ASA) in Business Valuation, and is a Governance Fellow of the National Association of Corporate Directors (NACD).
